For me the critical issue is the fact that students do not understand what
is evidence and what is not. I have not found a BLAW text that deals with
vevn the most rudimentary aspects of evidence, yet students frequently
preface their questions with, "How do you know (prove)...? Each semester I
take a part of one class to explain what is and what is not evidence. Most
students do not know that Perry Mason's pronouncements are not evidence
that a jury should consider.
 
I think before we can talk about searches and seizures we need to explain
what evidence is.
