NOTICE OF PUBLIC HEARING
Notice is hereby given that the Division of State Fire Marshal will convene
a public hearing in accordance with Chapter 119. of the Revised Code at
1:30 p.m., Friday, October 16, 1998, in Room 130 at the Ohio Fire Academy,
8895 East Main Street, Reynoldsburg, Ohio 43068. Purpose of the public
hearing is to consider proposed rules of the Administrative Code identified
as 1301:7. These rules are contained herein in a condensed format with the
section of text being amended only.
PROPOSED AMENDMENTS TO RULE 1301:7
Rule 1301:7-5-08 Hotel and SRO facility license
(H) FM-124.8 License Limitations: Each applicant for a hotel license shall
specify on the application provided by the fire marshal whether the
facility is: (1) A place where sleeping accommodations are offered for pay
to transient guests for a period a OF thirty days or less and/or (2)
Specifically constructed and used as a temporary residence to persons
either relocating their residence in an area or on temporary work
assignment in an area.
(a) (1) FM-124.8.1 Each applicant for an SRO facility license shall specify
on the application provided by the fire marshal which rooms are offered for
occupancy for a period of thirty days or less for the purpose of
determining compliance with division (D) of section 3731.03 of the Revised
Code.
(b) (2) FM-124.8.2 Use group classification: Each hotel or SRO facility
shall provide documentation of a use group classification as approved and
issued by the building official having jurisdiction in accordance with the
rules adopted by the board of building standards and paragraphs
(H)(2)(a)(FM-124.8.1) to (H)(2)(b)(FM-124.8.2.2) of this rule.
(i) (A) FM-124.8.2.1 Each SRO facility shall provide documentation of a use
group classification R-2 as approved and issued by the building official
having jurisdiction. Any facility operating prior to October 16, 1996, in
the nature of an SRO facility, whether previously licensed as a hotel or
not, shall be permitted to provide documentation of a use group
classification of either R-1 or R-2 as approved and issued by the building
official having jurisdiction.
(ii) (B) FM-124.8.2.2 Those hotel/motel facilities specifically
constructed, kept, used, maintained, advertised, and held out to the public
to offer a temporary residence to persons either relocating their residence
in an area or on temporary work assignment in an area shall provide
documentation of a use group classification approved and issued by the
building official having jurisdiction that permits the R-1/R-2 use by such
facilities.

Rule 1301:7-7-02 Chapter 2 Definitions
(B) Section FM-202.0 General definitions
Underground storage tank: See division (P) of section 3737.87 of the
Revised Code. MEANS ONE OR ANY COMBINATION OF TANKS, INCLUDING THE
UNDERGROUND PIPING CONNECTED THERETO, THAT ARE USED TO CONTAIN AN
ACCUMULATION OF FLAMMABLE OR COMBUSTIBLE SUBSTANCES THE VOLUME OF WHICH,
INCLUDING THE VOLUME OF THE UNDERGROUND PIPES CONNECTED THERETO, IS TEN
PERCENT OR MORE BENEATH THE SURFACE OF THE GROUND.

Rule 1301:7-7-05 Chapter 5 Fire Protection Systems
(A) Section FM-500.0 Certification
(5) FM-500.5 Upon satisfactory application, the fire marshal may certify
any individual or provisional individual to service, test, repair or
install fire protection or fire fighting equipment in the following
categories:
(a) Automatic sprinkler and standpipe systems;
(b) Fire service mains;
(c) Fire pumps;
(d) Fire alarm and detection equipment;
(e) Portable fire extinguishers;
(f) Engineered extinguishing equipment other than water;
(g) Pre-engineered extinguishing equipment other than water; or
(h) Such other categories as deemed necessary by the fire marshal.
An individual must be a company CERTIFIED PURSUANT TO PARAGRAPH (A) (4)
(FM-500.4) OF THIS RULE or must be associated with a CERTIFIED company in
order to be certified in one or more of the above categories, WHEN SUCH
INDIVIDUAL ENGAGES IN THE BUSINESS OF SERVICING, TESTING, REPAIRING OR
INSTALLING FIRE PROTECTION OR FIRE FIGHTING EQUIPMENT FOR PROFIT. and AN
INDIVIDUAL may only work in those categories for which he has been
certified pursuant to paragraph (A)(5)(FM-500.5) of this rule. Individuals
may only work on those particular engineered or pre-engineered systems for
which they have recent experience or education to show competence and have
provided documentation thereof to the fire marshal. A provisional
individual must be supervised by a certified individual at all times.
(6) FM-500.6 Certification procedure
(a) Applications for certification and renewals shall be made on forms
provided by the fire marshal. All applications and renewals shall be
accompanied by the appropriate fee, to be made payable to “Treasurer, State
of Ohio”. Applications for renewal must be received by the state fire
marshal thirty days prior to the expiration date. Individual certification
licenses and company certification of an individual operating alone (sole
proprietorship) expire in accordance with the following schedule: last name
beginning with “a-g” on January second of each year; last name beginning
with “h-m” on April first of each year; last name beginning with “n-s” on
July first of each year; and last name beginning with “t-z” on October
first of each year. All other company certification licenses expire on
June thirtieth of each year. Renewal shall be pursuant to standard renewal
procedure.
Those seeking certification to work on a particular engineered or
pre-engineered system must show at least one of the following:
(i) Proof from the manufacturer of training or approval to work on the
manufacturer’s engineered or pre-engineered system; or
(ii) Recent experience or education sufficient to show competence to work
on a particular engineered or pre-engineered system.
(c) Original application for certification and renewal of an individual or
provisional individual shall, at a minimum, include the following:
(i) Name of applicant;
(ii) Name and primary business address of company with which applicant will
be associated;
(iii) (ii) Categories for which applicant is seeking certification;
(iv) (iii) If a non-resident, an irrevocable consent to legal service in
Ohio (needed for original application only); and
(v) (iv) If for a provisional individual, a copy of the indentured
agreement.
(8) FM-500.8 A certificate issued pursuant to paragraph (A)(FM-500.0) of
this rule may be suspended or revoked by the fire marshal for the following
reasons:
(a) For knowingly violating any provision of the “Ohio Basic Building
Code,” the “Ohio Fire Code,” or the Revised Code.
(b) For engaging in or permitting a person to engage in activity requiring
certification, but for which activity the person is not certified;
(c) For gross negligence or gross incompetence;
(d) For knowingly making any misrepresentation or false promise, or for
dishonest or illegal dealing;
(e) For a continued course of misrepresentation or the making of false
promises individually, through employees or agents, through advertising, or
otherwise;
(f) In the case of a company, for failure to notify the fire marshal of
change of primary business address;
(g) In the case of an individual, for failure to notify the fire marshal of
a change in company;
(h) (G) In the case of a provisional individual, for failure to complete
the apprenticeship program.

(13) FM-500.13 ANY CERTIFIED INDIVIDUAL OR CERTIFIED COMPANY THAT CHANGES
THE PRIMARY MAILING ADDRESS AS PREVIOUSLY FILED WITH THE FIRE MARSHAL,
SHALL SUBMIT NOTIFICATION OF SUCH CHANGE OF ADDRESS TO THE FIRE MARSHAL
WITHIN THIRTY DAYS OF THE CHANGE OF ADDRESS.

(O) Section FM-514.0 Automatic fire detection systems
(8) FM-514.8 Smoke detector sensitivity: Detector sensitivity shall be
within one year after installation at five year intervals thereafter. The
sensitivity testing shall be conducted by random selection and the number
of smoke detectors shall be as required in Table FM-513.8 FM-514.8. The
random selection for sensitivity testing shall require a minimum of one
detector per zone and/or one per floor which ever is the greatest number.
Detectors with abnormal sensitivities shall be replaced or cleaned and
recalibrated. To determine whether each smoke detector is within proper
sensitivity range, the detector shall be tested in accordance with any of
the following:
(a) A calibrated test method;
(b) The manufacturer’s calibrated sensitivity test instrument;
(c) Approved control equipment arranged for the purpose; or
(d) Other approved calibrated sensitivity test method.

(H) Section FM-708.0 Tornado shelters in schools
(2) FM-708.2 Specific safety requirement
(F) EACH LOCAL FIRE OFFICIAL CONDUCTING THE ANNUAL INSPECTION OF EACH
SCHOOL OR INSTITUTION SHALL BE DESIGNATED PURSUANT TO SECTION 3737.73(c) OF
THE REVISED CODE TO VERIFY COMPLIANCE WITH THE TORNADO SAFETY PROVISIONS OF
THIS RULE.

Rule 1301:7-7-08 Chapter 8 Airports, Heliports and Helistops
(B) Section FM-802.0 Service areas
(1) FM-802.1 General: A person shall not install, operate or maintain an
aircraft service, except in accordance with the provisions of rule
1301:7-7-32 1301:7-7-28 of the Administrative Code. All transferring
apparatus, pumps, hoses, electrical equipment, fueller units and accessory
equipment shall be approved and in compliance with NFPA 407 listed in rule
1301:7-7-44 of the Administrative Code.

Rule 1301:7-7-31 Chapter 31 Fireworks
(39) “Mortar” means a metal tube from which aerial shells are fire INTO THE
AIR.
(10) FM-3107.10 Safety requirements: All public fireworks exhibitions shall
be conducted in accordance with the following:
(a) FM-3107.10.1 Mortars: All mortars used in a fireworks exhibition that
are greater than or equal to eight inches in diameter shall be equipped
with electronic ignition equipment in accordance with NFPA 1123 listed in
rule 1301:7-7-44 of the Administrative Code. ALL MORTAR RACKS SHALL BE
SECURELY POSITIONED IN ACCORDANCE WITH THE REQUIREMENTS OF NFPA 1123. THE
METHODS USED TO SECURELY POSITION THE MORTAR RACK SHALL NOT INCLUDE THE USE
OF PLASTIC TIES OR ANY MATERIAL THAT MAY EASILY BREAK, DISLODGE, OR
OTHERWISE PERMIT THE REPOSITIONING OF THE MORTAR RACK.
