My colleague Eli Bortman just sent this link to a FCPA settlement.

Robert and Richard,

The Frederic Bourke case sounds like it may fit the bill:

I saw another reference to the case stating that it includes opinions addressing substantive FCPA issues, though you may have to dig a little to obtain the opinions.

Now, what we doing working on New Year's Day?

Does anyone have a suggestion for a good FCPA court case for class discussion? I've been searching online for FCPA cases and most of them deal with single narrow issue or are tied up in procedural problems. Others just mention the FCPA in passing, focus on jury instructions only, or are too confusing to be worth assigning to students.

I'm looking for a opinion that clearly lays out all of the elements of the FCPA and goes through the elements step-by-step applying them to the facts. A scintillating story behind the law would be a nice bonus.

Happy New Year!

Robert
